1. Agreement to these Terms
By accessing or using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to them, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
We may change the Services or these Terms from time to time. When we make material changes, we will update the effective date above and post the revised Terms here. Continued use after the effective date means you accept the revised Terms, to the extent permitted by law.
2. Eligibility and accounts
You must comply with the age rating, applicable law, and any platform requirements for the Service you use. If you are under the age of majority in your jurisdiction, you may use the Services only with permission from a parent or legal guardian.
You are responsible for activity carried out through your account or connected platform account. Keep access credentials secure and promptly notify us if you believe your account has been compromised.
3. License and ownership
Subject to these Terms, GacoGames grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial entertainment or the intended community purpose.
All rights, title, and interest in the Services—including games, software, characters, artwork, names, logos, text, audio, visual content, and other intellectual property—belong to GacoGames or its licensors. These Terms do not give you ownership of the Services or their content.
4. Acceptable use
You must not, and must not help others to:
- break the law or violate another person’s rights, privacy, or intellectual property;
- harass, threaten, impersonate, defame, exploit, or harm others;
- use cheats, bots, automation, exploits, reverse engineering, or other unauthorized means to access, interfere with, or gain an unfair advantage in a Service;
- introduce malware, disrupt servers or networks, bypass security controls, or attempt unauthorized access;
- copy, sell, rent, distribute, modify, or create derivative works from the Services except where law expressly permits it; or
- use the Services for unsolicited promotion, spam, or any commercial purpose not expressly approved by GacoGames.
We may investigate violations and suspend, restrict, or terminate access where we reasonably believe these Terms, platform rules, or law have been violated.
5. Discord applications
GacoGames Discord applications are provided through Discord and are also subject to Discord’s own terms, policies, and community guidelines. You must have the permissions required by Discord and the server where you use an application.
Do not use our Discord applications to submit unlawful, harmful, infringing, or abusive material. Server administrators are responsible for deciding whether and how to add an application to their server. We may modify, suspend, or discontinue a Discord application or particular features at any time.
6. Purchases and third-party platforms
Some Services may offer paid content, virtual items, or subscriptions through a third-party platform. Purchases are governed by the platform’s terms, billing rules, and refund policies. Unless required by law or the relevant platform’s policy, payments are non-refundable. Virtual items have no real-world value and may not be sold, transferred, or exchanged outside the Service unless we expressly permit it.
Links to third-party services are provided for convenience. We do not control and are not responsible for their content, availability, or practices.
7. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” GacoGames makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.
To the maximum extent permitted by law, GacoGames and its licensors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity, arising from or related to the Services or these Terms. Where liability cannot be excluded, it will be limited to the amount you paid to GacoGames for the relevant Service during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the above provisions apply only to the extent permitted by law.
8. General terms
Termination
You may stop using the Services at any time. We may suspend or end your access if we reasonably believe you have violated these Terms, create risk or legal exposure for us or others, or if we discontinue a Service. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise. You and GacoGames agree that disputes will be resolved by the courts with jurisdiction under applicable Indonesian law, unless applicable law provides another forum.
